Further, We reserve the right to amend, modify or change any of the terms of this agreements at any time , and it is advised to the user to regularly look at the terms. We shall notify the same in the manner as the company may deem fit or by posting the amended agreement on the platform. Such modifications could include changes to any of our show/competition Rules.

In case you do not agree with the terms and conditions and any modified terms and conditions, you may terminate your use of the services will be deemed to constitute your acceptance of the changes to the agreement.

• This Skill show/competition Application/show is a public invitation, hence the user who voluntarily desires to install and take the benefit of this Application/show is to provide information about his personal details and identification information voluntarily and we only use details and information where we have a legal basis to do so, please refer to our Privacy Policy to help you understand what information we gather, how we use it.

• User agree that personal data submitted with an entry, including name, mailing address, phone number, and email address may be collected , processed , stored and otherwise used by QuizMaster, at affiliates and consultants for the purposes of conducting and administering the QuizMaster competition.

• By entering the QuizMaster, user agree to the transmission, processing, disclosing and storage of personal data by QuizMaster, its affiliates and the consultants.

We reserve right to revise, modify and update our privacy policy from time to time and these updates will take effect from the date of issue on the site. Users shall check back regularly for updates. Continued use of services will signify your acceptance of the changes to this Privacy policy.

To use services under this agreement, user/you will have to create an account with us (“an account”) and you will also need access to a supported mobile phone and an internet connection.

User can create account using below mentioned third party accounts:

• Mobile number
• Pre-existing google account
• Pre-existing facebook account
• Any such other third party accounts that we support, as selected by you on the app account creation screen. It is agreed and deemed that, the details as would be provided are provided with free consent voluntarily by the respective User. Further, the user/you agree that you wont disclose your account password to anyone and you will notify to us immediately of any unauthorised use of your account. Thereby you will be responsible for all activities that occur under your account.

• We recognise the importance of safeguarding the privacy of children and encourage parents to check and monitor their children’s use of online activities regularly.
• In order to participate in the game, user/you must be at least 18 years of age and above and competent to enter into a contact as per the provisions of Indian Contract Act, 1872. Further as this is Skill game and educative in objective, the minor may participate with the help of his lawful guardian who will be the user.

• To participate in the quiz, you must satisfy the following criteria’s:

  • You must be at least 18 years of age, and must not suffer from any disability or impairment which would prevent you from assuming the responsibilities contained in the agreement or from participating in the games which are offered as part of the services. Further as this is Skill competition/show and educative in objective, the minor may participate with the help of lawful custodian who will be the user.
  • You must be a resident of India.
  • Employees, agents and promoters (including their immediate family members) affiliates, and subsidiaries, and others associated with the activity in any manner, are not eligible to participate in the contest/show.
  • You must satisfy yourself that it is legal for you to participate in prize competition/show in the specific jurisdiction from which you are accessing the services.
  • You must possess a valid PAN number, or provide valid PAN number of lawful custodian which will be associated with your account and which you will provide us upon request.
  • The user agrees that he/she can only access the application from territories that are not classified as restricted territories. Any access to our website or mobile application by the suer from a restricted territory through the usage of IP or GPS masking software such as Fake GPS Location etc will amount to breach of our terms and conditions. This will lead to permanent blacklisting, deletion of the username and closure accounts and also forfeiture of the entire cash prize/balance, without any prior notice to the user. Further, such activities are also a breach of applicable laws for which the user shall be solely responsible for the consequences on the user for illegally accessing our platforms by breaching our security protocol.
  • Users who do not fulfil the above criteria are expressly barred from participating in prize competition and would not be entitled to receive any prizes which they may win as a result of participation in the prize competition/show.

• Use of QuizMaster and any of the names, logos associated with the platform, the service, or the software is strictly forbidden unless it is used with the express written permission of the company.

• The platform, services, softwares including codes, documentation, appearance, structure, and organisation is an exclusive product of the QuizMaster Private Limited, which retains all rights, tangible and intangible, to QuizMaster the appliacation/show therein, software therein, software codes, copies, modifications, all intellectual property rights registered or unregistered would lie with the QuizMaster Private Limited.

• You acknowledge that all copyright, trade marks, and other intellectual property rights in and relating to our services (other than content which is contributed and owned by players) is owned by or licensed to us.

• Whilst you are in compliance with these terms, we grant you a non exclusive, non- transferable , personal, revocable limited licence to access and /or use our services( but not any related object and source code) for your own personal private use, in each case provided that such use is in accordance with these terms.

• You agree not to use our services for anything else. These terms also apply to any updates which we may release or make available for any of the services and any such update or patch shall be deemed part of the services for the purposes of these terms.

• We provide access to valid registered users to use our application and compete in the competition or show including without limitation to online quiz competition. The company provides software and IT services to enable competition to be competed/played with other individuals over the internet/show. The services provided by the company are only intended to facilitate skill competition.

• The company shall charge service charges/ entry fee provided in the table below for prize competition/show from all the users participated in said prize competition/show. Which would be inclusive of Service Tax/GST as may be applicable. The service charge may vary from time to time and depending upon the competition variants..

LIVE QUIZ

• Users above 18 years can participate in the competition/show on a daily basis.

• Everyday the quiz will feature 12 questions at 10 pm. On Sunday the Grand Quiz will be held at 10:30 pm.

• Each question will appear in the Multiple Choice Question (MCQ) format. The question will appear along with 3 options and only one of the three options will be correct.

• The winners are chosen based on the speed of answering the question.

• All questions will appear on the user’s device screen. Each question will be live for a period of 10 seconds.

• The questions will cover a diverse group of General Knowledge Categories. The categories includes: Current affairs, Entertainment, Sports and games, History, Geography, Travel, Science, Business, Technology, Arts and culture among others.

• The Questions will appear in the language chosen by the user, the languages are: Kannada, Hindi, English, Tamil, Telugu, Malayalam, Marathi, Gujarati, Bengali, odia, Bhojpuri.

• Each question which would appear on screen or computer generated and the successful winners chosen or by the computer intelligence programmed, which is tamper proof . Hence, there will not be any human interference in choosing the questions and respective winners.

• Each question in the QuizMaster can be attempted by paying a registration or entry fee as mentioned in the table below

• To the extent permitted under applicable law, QuizMaster shall not be liable for any personal injury, product liability or damages resulting from the platform or the services, including but not limited to loss of data, goodwill, earnings, revenue, lost income or business interruption.

• You agree to indemnify and hold QuizMaster and its employees, officers and directors harmless from all liabilities, claims and expenses, including attorney’s fees, that arise from your use or misuse of the services or your violation of the user terms.

If any part of these terms is held to be valid or unenforceable under any applicable local laws or by an applicable court , that part shall be interpreted in a manner consistent with applicable law to reflect as nearly as possible our original intentions and the reminder of these terms shall remain valid and enforceable. If it is not possible to interpret an invalid or unenforceable part of these terms in a manner consistent with applicable law, then that part shall be deemed deleted from these terms without affecting the remaining provisions of these terms.

Any tax/levies/duty etc., as applicable on material prizes, shall be paid by the winner of the game. Based on TDS (Tax Deduction at Source) rules for any sort of game winning in India, 30 % TDS should be deducted on any winning above Rs.10,000/- (Rupees Ten Thousand Rupees Only) in a single game.

• In the event, that there is an error in the services provided by us, we may refund the designated amount paid, provided the reasons are genuine and proved after investigation by QuizMaster Team. Hence, it is advisable that the user read the rules of competition/show before contesting.

• We will try our best to create the best user experience for you. If paid by credit card, refunds will be issued to the original credit card provided at the time of purchase and in case of payments made through a payment gate away, payment refunds will be made to the same account.

• User must use any money in their account within 30 days. QuizMaster shall have the right to directly forfeit any such unused amount after 30 days without prior notice to such User. QuizMaster does not permit any such withdrawal against any idle balance lying in any user’s QuizMaster Account except in accordance with applicable law.

• Any winnings of the Quiz/Competition (subject to tax deduction at source) will be credited to the user’s wallet within 30 minutes of completion of game. To withdraw the same, the user will need to complete KYC form as provided in the application.

QuizMaster shall use contact details provided by the user so as to keep them updated regarding the show/competition, launches, any modifications, notices, advertisements, promotions, invites etc.

In order to compete in the show/competition you will be required to send and receive money, We may use third party electronic payment systems to process such financial transactions. By accepting our privacy policy, you are expressly consent to personal information necessary for the processing or transactions including where necessary, transfer of information. Further, we ensure that our arrangements with payments systems protect your privacy.

• QuizMaster shall not be liable for any delay or failure to perform resulting from causes outside its reasonable control, including but not limited to any failure to perform due to unforeseen circumstances or cause beyond QuizMaster control such as acts of god, war, terrorism, riots, embargoes, acts of civil or military authorities, natural calamities, accidents, network infrastructure failures, strikes, or shortages of transportation facilities, energy, labours etc. in such circumstances , QuizMaster shall also be entitled to cancel any related contest(s) and to process an appropriate refund for all participants.

• Users agree that regardless of any statute or law to the contrary, any claim or cause of action arising out of or related to use QuizMaster or the terms must be filed within thirty(30) days of such claim or cause of action arising or be forever barred.

QuizMaster may from time to time conduct/organise, promotions/offers on the platform.

We may suspend or terminate your access to use of the services, at our sole discretion , at any time and without serving any notice to you, including if you comply with the below mentioned terms:

• We suspect fraud, cheating, or misuse by you of content or services;

• If your account is inactive (i.e, not used or logged-into) for a period of time, However, we will notify you via services or in the app prior to termination of your account.

• Account may be terminated at any time by visiting the application Upon termination of any service or your account, the following provisions of these terms will survive:

• Rights granted by you
• Disclaimer of warranties
• Limitation and liability
• Dispute resolution
• General terms.

User shall agree that in the event you commit a breach ( as may be determined by the company) of any of the terms of the agreement, or the company in its sole discretion) of any of the terms of the agreement, or the company in its sole discretion determines that your continued access to the services is prejudicial , other users or public interest, the company may take any one or more of the following steps:

• Suspend or delete accounts

• Bar or restrict you from use of our platform

• Forfeit any coins in the wallet or platform account

• Report any such illegal and suspicious activity to the concerned governmental and financial authorities.

• Any such actions as enumerated above which may be taken by the company would be without prejudice to any other legal or equitable rights/remedies available to the company.

• Any dispute arising out of the user terms and the use of the services shall be under the exclusive jurisdiction of the Indian law and courts.

• The platform may be controlled and operated through any country/states in India and will be subject to the laws of the state in which they are controlled and operated by the user. If you use the platform from any location, then you will be responsible for compliance with the local laws applicable to you.

• Any such dispute arising out of this agreement any interpretation and modifications and validity of the terms thereof and the respective rights and obligations of the parties shall be settled through arbitration.

• The arbitration shall be governed by the Arbitration and conciliation Act, 1996 (India) or any statutory amendments/modifications thereto for the time being in force.

• Any such Arbitration proceedings shall be held at Bangalore, Karnataka by a sole arbitrator who shall be appointed by QuizMaster and whose decision shall be final and binding upon all the parties. Arbitration shall be held at Bangalore and the language of the Arbitration shall be in English.

• You and the QuizMaster shall agree that any cause of action arising out of your use of the platform must be commenced withing 3(three) months after the cause of action accrues or from the date of realisation of the facts giving rise to the cause of action, whichever is later. Otherwise, such cause of action shall be permanently barred.
